{"id":182,"date":"2012-05-15T12:47:17","date_gmt":"2012-05-15T16:47:17","guid":{"rendered":"http:\/\/themooneylawfirm.wordpress.com\/?p=182"},"modified":"2012-05-15T12:47:17","modified_gmt":"2012-05-15T16:47:17","slug":"not-every-company-in-logistics-can-join-c-tpat","status":"publish","type":"post","link":"https:\/\/www.customscourt.com\/es\/not-every-company-in-logistics-can-join-c-tpat\/","title":{"rendered":"When Is C-TPAT Right For You?"},"content":{"rendered":"<p style=\"text-align:justify;\">The Customs-Trade Partnership Against Terrorism (C-TPAT) was established to ensure\u00a0the safety and security of cargo arriving in the United States. Although being C-TPAT certified\u00a0is not required by any governmental agency, many private companies only partner with C-TPAT\u00a0compliant businesses. Thus, Third Party Logistics Providers (3PLs) are strongly motivated to\u00a0obtain certification.<\/p>\n<p style=\"text-align:justify;\">However, in order for a 3PL to be eligible for C-TPAT certification it must meet some\u00a0minimum requirements. For example, it <strong>MUST<\/strong> do all of the following:<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">1. Be directly involved in the handling and management of the cargo from point of stuffing\u00a0overseas up to the first U.S. port of arrival. (Entities which only provide domestic\u00a0services and are not engaged in cross border activities are not eligible.)<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">2. Manage and execute these particular logistics functions using its own transportation,\u00a0consolidation and\/or warehousing assets and resources.<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">3. Be licensed and\/or bonded by one of the following: the Federal Maritime Commission,\u00a0the Transportation Security Administration, U.S. Customs and Border Protection, or the\u00a0Department of Transportation, and<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">4. Maintain a staffed office within the United States.<\/p>\n<p style=\"text-align:justify;\">And in order to participate in the C-TPAT program a 3PL may <strong>NOT<\/strong>:<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">1. Subcontract any service beyond a second party other than to other CTPAT members\u00a0(This means that CBP does not allow the practice of \u201cdouble brokering\u201d, the 3PL\u00a0may contract with a service provider, but it may not allow that contractor to further\u00a0subcontract the actual provision of this service to an unknown third party).<\/p>\n<p style=\"text-align:justify;padding-left:30px;\">2. Be a non asset-based 3PL which only performs duties such as quoting, booking,\u00a0routing, and auditing (these type of 3PL may possess only desks, computers, and freight\u00a0industry expertise) without its own warehousing facilities, vehicles, aircraft, or any other\u00a0transportation assets. These non-asset based entities are excluded from C-TPAT as they\u00a0are unable to enhance supply chain security throughout the international supply chain.<\/p>\n<p style=\"text-align:justify;\">If your business is not otherwise eligible for C-TPAT certification but desires to obtain it,\u00a0it might consider obtaining one of the necessary agency licenses.
