I. Virginia Forwarder<\/strong><\/p>\n\n\n\n

The U.S. Department of the Treasury\u2019s Office\nof Foreign Assets Control (OFAC) issued a Finding of Violation to DNI Express\nShipping Company (\u201cDNI\u201d), incorporated in McLean, Virginia, for a violation of\n\u00a7 501.602 of the Reporting, Procedures and Penalties Regulations, 31 C.F.R.\npart 501 (RPPR) as to the provision of farm equipment to Sudan. Specifically,\nDNI violated \u00a7 501.602 of the RPPR by providing information to OFAC during the\npendency of OFAC\u2019s investigation, including a subpoena response, that contained\ncontradictory, false, materially inaccurate, materially incomplete, and\nmisleading statements.<\/p>\n\n\n\n

OFAC considered the following to be\naggravating factors:<\/p>\n\n\n\n

(1) DNI, through counsel, demonstrated\nreckless disregard for its U.S. sanctions requirements by failing to provide\naccurate and complete information in response to an OFAC Administrative\nSubpoena; <\/p>\n\n\n\n

(2)\nDNI, and its owner, facilitated both the shipment and attempted shipment of\ngoods to Sudan and provided financing for such shipments. Accordingly, DNI had\nactual knowledge that its responses to OFAC\u2019s Administrative Subpoena\nconcerning the facilitation of the shipment and attempted shipment of goods to\nSudan and related financing were false, materially inaccurate, materially\nincomplete, and misleading; <\/p>\n\n\n\n

(3)\nAfter supplying OFAC with responses that were false, materially inaccurate,\nmaterially incomplete, and misleading, OFAC gave DNI the opportunity to correct\nor clarify its original responses. However, DNI failed to appropriately amend\nits responses and instead confirmed its original responses; and <\/p>\n\n\n\n

(4)\nBy providing false, materially inaccurate, materially incomplete, and\nmisleading statements, DNI did not fully cooperate with OFAC\u2019s investigation.<\/p>\n\n\n\n

II. Florida Shipper<\/strong><\/p>\n\n\n\n

Separately,\nOFAC issued a issued a Finding of Violation to Southern Cross Aviation, LLC\n(\u201cSouthern Cross\u201d), incorporated in Florida and with offices in Florida and\nNorth Carolina, for a violation of the RPPR. OFAC stated it had reason to\nbelieve that Southern Cross was recently involved in the sale of several\nhelicopters destined for Iran via an Iranian businessman based in Ecuador.  Southern Cross violated \u00a7 501.602 of the RPPR\nby failing to provide complete information to OFAC in response to an\nAdministrative Subpoena issued to Southern Cross. <\/p>\n\n\n\n

OFAC\nconsidered the following to be aggravating factors: <\/p>\n\n\n\n

(1)\nSouthern Cross demonstrated reckless disregard for its U.S. sanctions\nrequirements by failing to provide accurate and complete information in\nresponse to an OFAC Administrative Subpoena; <\/p>\n\n\n\n

(2)\nSouthern Cross had actual knowledge or reason to know of the conduct that led\nto the violation in this instance; and <\/p>\n\n\n\n

(3)\nSouthern Cross did not fully cooperate with OFAC\u2019s investigation.<\/p>\n\n\n\n
