Effective October 14, 2025, these fees apply to vessels that are owned, operated, or built in China, as well as to all foreign-built vehicle carriers.<\/p>\n\n\n\n<p>These measures, outlined in the <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/04\/23\/2025-06927\/notice-of-action-and-proposed-action-in-section-301-investigation-of-chinas-targeting-the-maritime\" target=\"_blank\" rel=\"noopener\"><em>Federal Register Notice<\/em> of April 17, 2025<\/a> (<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/06\/12\/2025-10660\/notice-of-proposed-modification-of-action-in-section-301-investigation-of-chinas-targeting-the\" target=\"_blank\" rel=\"noopener\">as modified June 12, 2025<\/a>), mark a significant escalation in U.S. trade actions targeting China\u2019s maritime and logistics industries. The fees are intended to counter what the U.S. Trade Representative (USTR) has described as \u201cunfair Chinese policies and practices\u201d in the global shipbuilding and shipping markets.<br \/><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What the New Fees Require<\/strong><\/h2>\n\n\n\n<p>Under the final rules, vessel operators\u2014not U.S. Customs and Border Protection (CBP)\u2014are responsible for determining whether the fee applies and for ensuring timely payment. Operators who fail to provide proof of payment before arrival risk denial of lading or unlading operations, and clearance may be withheld until payment can be verified.<\/p>\n\n\n\n<p>It is strongly recommended by CBP that payments be made at least three business days before vessel arrival.<\/p>\n\n\n\n<p>The following fees apply under each Annex:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Annex I:<\/strong> $50 per net ton for any vessel owned or operated by a Chinese entity.<br \/><\/li>\n\n\n\n<li><strong>Annex II:<\/strong> The higher of $18 per net ton <strong>or<\/strong> $120 per container discharged for any vessel built in China.<br \/><\/li>\n\n\n\n<li><strong>Annex III:<\/strong> $14 per net ton for any vehicle carrier or roll-on\/roll-off vessel, regardless of country of ownership.<\/li>\n<\/ul>\n\n\n\n<p><em>Liquefied Natural Gas (LNG) tankers (vessel type 132) are exempt from these fees.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Payment and Documentation Procedures<\/strong><\/h2>\n\n\n\n<p>Fees must be paid electronically via the Department of the Treasury\u2019s Pay.gov portal using the Section 301 Fee Payment Form. Payments will not be accepted at the port of entry.<\/p>\n\n\n\n<p>The form will require vessel and voyage details, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Vessel name and IMO number<br \/><\/li>\n\n\n\n<li>Arrival port and estimated arrival date<br \/><\/li>\n\n\n\n<li>Voyage number<br \/><\/li>\n\n\n\n<li>Operator and payor contact information<\/li>\n<\/ul>\n\n\n\n<p>Once submitted, Pay.gov will generate a payment confirmation transmitted to CBP\u2019s Vessel Entrance and Clearance System (VECS). If VECS cannot automatically match the payment, operators may present the confirmation email as proof of payment.<\/p>\n\n\n\n<p>Operators using VECS should review and confirm all entry details and promptly update any changes.
