39 Chinese Companies Added To DHS Entity List

On January 15, 2025, the United States Department of Homeland Security (“DHS”) added 39 companies to the Entity List (the “List”) under the Uyghur Forced Labor Prevention Act (“UFLPA”). Entities on the list are those entities working with the government of the Xinjiang Region to recruit, transport, transfer, harbor or receive forced labor or Uyghurs and members of other persecuted groups out of the region and/or entities that source material from Xinjiang or from persons working with the government of Xinjiang or the Xinjiang Production and Construction Corps for purposes of the “poverty alleviation” program or the “pairing-assistance” program or any other government labor scheme that uses forced labor. See 90 FR 3899. Goods produced, mined, or manufactured by entities on the List are presumed to be prohibited from importation into the United States under 19 U.S.C. § 1307. The 39 entities added to the list are as follows:

  • Aksu Biaoxin Fiber Co., Ltd. (formerly known as Aksu Shangheng Fiber Co., Ltd.)
  • Aksu Huafu Color Spinning Co., Ltd. (also known as Aksu Huafu Textiles Co., Ltd.; Akesu Huafu; Aksu Huafu Dyed Melange Yarn; and Akesu Huafu Melange Yarn Co., Ltd.)
  • Awati Huafu Textile Co., Ltd.
  • Baotou Meike Silicon Energy Co., Ltd.
  • Donghai JA Solar Technology Co., Ltd.
  • Hongyuan Green Energy Co., Ltd. (also known as HY Solar; and Hoyuan Green Energy Co. Ltd. and formerly known as Wuxi Shangji CNC Co., Ltd.; Wuxi Shangji Automation Co., Ltd.; and Wuxi Shangji Grinding Machine Co., Ltd.)
  • Hongyuan New Materials (Baotou) Co., Ltd.
  • Huafu Fashion Co., Ltd.
  • Huyanghe Huafu Hongsheng Cotton Industry Co., Ltd.
  • Jiangsu Meike Solar Technology Co., Ltd. (also known as Meike Co. and formerly known as Jiangsu Gaozhao New Energy Development Co., Ltd.)
  • Kuche Zongheng Cotton Industry Co., Ltd.
  • Kuitun Jinfu Textile Co., Ltd.
  • Ningbo Huafu Donghao Industrial Co., Ltd.
  • Ninghai Huafu Textile Co., Ltd.
  • Shaya Yinhua Cotton Industry Co., Ltd.

  • Xinjiang Zijin Zinc Industry Co., Ltd.
  • Zhejiang Weixin Trading Co., Ltd.
  • Zijin Mining Group Co., Ltd.

DHS has also amended the name of an entity already on the List: 

  • Aksu Huafu Color Spinning Co., Ltd. (also known as Aksu Huafu Textiles Co., Ltd.; Akesu Huafu; Aksu Huafu Dyed Melange Yarn; and Akesu Huafu Melange Yarn Co., Ltd.

U.S. importers who wish to import from an entity on the list may only do so if granted an exception by the Commissioner of U.S. Customs and Border Protection (“CBP”). This requires providing CBP with clear and convincing evidence that the goods in question were not produced wholly or in part by forced labor, fully responding to all CBP requests for information, and demonstrating full compliance with CBP guidance. Moreover, entities on the List may submit a request to be removed from the list by submitting evidence that the criteria for addition to the list are not met.
